Personal carer's leave (sick leave) 

Under the national workplace relations system, if are a full-time or part-time employee you are entitled to paid leave if you are unable to attend work because you are sick. 

What has changed is that the new laws combine three workers' rights under the name personal carer's leave.

This is where a worker can apply for paid leave if:

  • they are sick and cannot go to work
  • they have to stay home to look after a sick child or partner or close family member
  • they are attending the funeral of a close family member.

Under the new laws, a full-time or part-time worker builds up their right to paid leave throughout the course of the year. By the end of the first year, a full-time worker will build up 10 days of paid personal carer's leave.  A part-time workers geta a proportion of this based on how many hours they work each week.

Unused personal carer's leave can usually be carried forward each year and continues to build up while you are with the same boss.

Remember, if you are a casual worker you will not be entitled to paid personal carer's leave.
